This End-User License Agreement (EULA) is a legal agreementbetween you (either an individual or a single entity) and the Author (GiladDenneboom) of this Software for the software product identified above, whichincludes computer software and may include associated media, printed materials,and “online” or electronic documentation (“SOFTWARE PRODUCT”).
By installing, copying, or otherwise using the SOFTWAREPRODUCT, you agree to be bounded by the terms of this EULA.
If you do not agree to the terms of this EULA, do not install or use theSOFTWARE PRODUCT.
SOFTWARE PRODUCT LICENSE
a) The SOFTWARE PRODUCT is being distributed as paid Software for personal,commercial use, non-profit organizations or educational purposes. You are NOTallowed to make a charge for distributing this Software whether as astand-alone product, or as part of a compilation or anthology, or to license,sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwisecommercially exploit the SOFTWARE PRODUCT or make the Application available toany third party without the explicit consent of Author.
1. GRANT OF LICENSE. This EULA grants you the followingrights: Installation and Use. You may only install and use a single copy of theSOFTWARE PRODUCT on a single computer. The SOFTWARE PRODUCT can be moved toanother computer, but only if the installation is completely removed from thecomputer where it was previously installed.
Reproduction and Distribution. You may NOT reproduce or distributethe SOFTWARE PRODUCT.
Copies of the SOFTWARE PRODUCTmay NOT be distributed as a standalone product or included with your ownproduct.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
You may NOT reverse engineer, decompile, or disassemble or change (add, deleteor modify the code or any comments within it) the SOFTWARE PRODUCT, except andonly to the extent that such activity is expressly permitted by applicable lawnotwithstanding this limitation.
Update and Maintenance
Updates for the SOFTWARE PRODUCT are FREE of charge.
Separation of Components.
The SOFTWARE PRODUCT is licensed as a single product. Its component parts maynot be separated for use on more than one computer.
Software Transfer.
You may permanently transfer all of your rights under this EULA, provided therecipient agrees to the terms of this EULA. If you do so you must inform theAuthor of this transaction.
Termination.
Without prejudice to any other rights, the Author of this Software mayterminate this EULA if you fail to comply with the terms and conditions of thisEULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT andall of its component parts.
3. COPYRIGHT.
All title and copyrights in and to the SOFTWARE PRODUCT (including but not limitedto any images, photographs, clipart, libraries, and examples incorporated intothe SOFTWARE PRODUCT), the accompanying printed materials, and any copies ofthe SOFTWARE PRODUCT are owned by the Author of this Software. The SOFTWAREPRODUCT is protected by copyright laws and international treaty provisions.Therefore, you must treat the SOFTWARE PRODUCT like any other copyrightedmaterial. The licensed users or licensed company can use all functions,example, templates, clipart, libraries and symbols in the SOFTWARE PRODUCT tocreate new diagrams and distribute the diagrams.
LIMITED WARRANTY
NO WARRANTIES.
The Author of this Software expressly disclaims any warranty for the SOFTWAREPRODUCT. The SOFTWARE PRODUCT and any related documentation is provided “as is”without warranty of any kind, either express or implied, including, withoutlimitation, the implied warranties or merchantability, fitness for a particularpurpose, or non-infringement. The entire risk arising out of use or performanceof the SOFTWARE PRODUCT remains with you.
NO LIABILITY FOR DAMAGES.
In no event shall the author of this Software be liable for any special,consequential, incidental or indirect damages whatsoever (including, withoutlimitation, damages for loss of business profits, business interruption, lossof business information, or any other pecuniary loss) arising out of the use ofor inability to use this product, even if the Author of this Software is awareof the possibility of such damages and known defects
